General Terms and Conditions

1 – General

Team Nijhof is an online auction for young horses organised by the private company Team Nijhof Sportstal B.V.
These Online Auction Conditions Team Nijhof Online Auction (“Auction Conditions”) are applicable to the legal relationships between the private company Team Nijhof Sportstal B.V., with its registered office in Geesteren gld, municipality of Berkelland, the Netherlands, and participants in the online auction of horses organised by Team Nijhof via the internet at https://team-nijhof.auction (“Auction Site”). A party that makes a bid for a horse or horses during the Auction (“Bidder”/”Buyer”) shall be deemed to have accepted the applicability of these Auction Conditions. The applicability of other general terms and conditions is excluded.
Sportstal Team Nijhof will organise and facilitate the Auction and auction the horses by order of a seller (“Seller”). Sportstal Team Nijhof is not the owner of the Horses offered for the Auction, unless this is explicitly mentioned on the Website.
The Buyer is the party that makes the bid during the Auction that is accepted as the highest bid by Team Nijhof on behalf of the Seller. A purchase agreement (“Purchase Agreement”) shall be concluded between the Buyer and the Seller as of the moment when Team Nijhof accepts a bid from a Bidder/Buyer as the highest bid (“Closing Price”). All of the clauses in these Auction Conditions have been made for the joint benefit of all those persons who work or have worked for, for the benefit of and/or on behalf of Team Nijhof. They can directly invoke the provisions of these Auction Conditions as if they were Team Nijhof itself.
All the amounts stated in these Auction Conditions are excluding VAT, unless stated otherwise.

2 – The auction

The Auction will take place under the management of Team Nijhof. Team Nijhof will determine the order and the sequence of the Auction. Team Nijhof has the right to refuse any party access to and/or participation in the Auction, without having to give reasons for such, and/or to set (further) conditions for participation in the Auction.
In order to participate in the Auction as a Bidder, registration must take place in the way prescribed by Team Nijhof, and the conditions and procedures that are applicable and/or are declared applicable by Team Nijhof for the Auction must be accepted. Team Nijhof reserves the right to refuse and/or unilaterally to end registration for the Auction and (further) participation of a Bidder in the Auction at any time for reasons of its own. The Bidder has to register at the Auction Site digitally in order to participate in the Auction. The Bidder will receive a strictly personal username and password which can be used to access the bidding system. The Bidder is responsible for all transactions that take place during the Auction and which arise out of the use of the Bidder’s username and password. Bidding shall take place by digital/electronic means. The highest bid for each horse will be displayed on the Auction Site.
The Auction will end at the time and date specified in advance. The duration of the Auction will be stated on the Auction Site. If a bid is received in the last five minutes before the specified close time, the open time will be (repeatedly) extended by another five minutes. The definitive close will then take place five minutes after the last bid.
A Bidder accepts that exceptional circumstances can occur with an online auction, such to include technical imperfections, as a result of which a bid cannot be made on time.
A bidder who has made the second-highest bid must honour his/her bid during a period of 14 days after the close of the online auction in the event the highest bid is declared invalid or is not honoured.
The horses offered at the Auction will be auctioned/sold “as is” with all faults, in the condition they are in when offered at the auction, without any liability of Team Nijhof in connection with the value, the condition and/or the capacity of the auctioned horses. The risk of loss of and/or of damage to and/or damage caused by the auctioned/purchased horse shall lie with the Bidder/Buyer as of the moment of conclusion of the Purchase Agreement.
The Bidder/Buyer shall bid for their own account and risk and will be obligated to honour their bid until a higher bid has been accepted.
Team Nijhof cannot guarantee that the Seller can transfer the ownership of an auctioned horse to the Bidder/Buyer free and unencumbered, and Team Nijhof will not be liable for any damages in connection with such.
As long as Team Nijhof has not received payment in full from the Bidder/Buyer, including any payments owed under any other Purchase Agreements, the Seller shall remain the owner of the horse. Up until such time, Team Nijhof shall have a right of retention on the horse. The Seller shall only have the right to release the horse to the Buyer after Team Nijhof has given its written permission for such.
Participation in the Auction implies that the buyer agrees, expressly and without any reservation, with these terms and conditions of auction and with the chargeability of the auction costs at a rate of 10% and 21% VAT (if applicable) on the hammer price.

3 – Information

Team Nijhof has compiled the Auction Site with the utmost of care. The information on the Auction Site is aimed at giving an impression of the quality of the horses offered at the Auction, without Team Nijhof thereby striving for completeness and no rights can be derived from such.
The horses offered at the Auction have been examined clinically by a veterinarian, the horses also have undergone a radiographic examination three months prior to the Auction. The x-ray images and a copy of the veterinary report drawn up on the basis of such can be inspected up to the end of the Auction by making a request.
The contents of the aforementioned veterinary reports will be binding for Team Nijhof, the Seller, and the Bidder/Buyer.
The horses offered at the Auction can be inspected prior to the Auction at a time and place to be determined by Team Nijhof.

4 – Closing price, buyer’s premium, purchase price, payment obligations of the buyer

The Buyer must pay the Purchase Price in Euros to Team Nijhof within seven (7) working days after the moment of conclusion of the Purchase Agreement by transfer to the bank account number in the name of Team Nijhof, without any discount or set-off. The Purchase Price will be calculated as follows: the Closing Price will be increased by an amount equal to 10% of the Closing Price (“Buyer’s Premium”), plus the applicable VAT rate. The VAT rate will depend on the capacity/nationality of the Seller, the Buyer, and the applicable regulations.
In the event of a failure to make timely payment of the Purchase Price, the Bidder/Buyer shall be in default and Team Nijhof shall have the right to immediately sell the horse privately, whereby the bid of the original Bidder/Buyer will become null and void. At no time shall the Bidder/Buyer be entitled to surplus proceeds in the event of a private sale, and shall remain obligated to compensate Team Nijhof for the lower proceeds. Furthermore, Team Nijhof shall then have the right to consider the Purchase Agreement as dissolved, on behalf of the Seller and without notice of default being required, and without the Bidder/Buyer being entitled to receive any compensation on account of such. In the event of a failure to perform by the Buyer, Team Nijhof shall have a right of retention on the horse, the Bidder/Buyer shall owe administration charges to Team Nijhof equal to 6% of the Closing Price, and the Bidder/Buyer shall owe Team Nijhof all judicial and extrajudicial costs associated with the collection of Team Nijhof claim against the Bidder/Buyer, with a minimum amount of € 1,000. The Buyer shall not have any right of set-off.

5 – Release, delivery, transfer of ownership and collection

After the Auction and the receipt of the Purchase Price (whether or not increased by VAT) by Team Nijhof, the buyer, the seller and Team Nijhof will agree the time and manner of the actual delivery of the horse. Unless agreed otherwise between Team Nijhof, the seller and the buyer, the horse will be picked up by the buyer at the location of the owner. The actual delivery of the horse must in any event take place within fourteen (14) days after the buyer has paid everything he/she had to pay to Team Nijhof under the agreement(s) concluded within the scope of the Auction. After these fourteen (14) days, the seller of the horse shall be entitled to charge the costs of stabling and maintenance of the horse to the buyer.

6 – Exclusion and limitation of the liability of Team Nijhof

Team Nijhof will not be liable for any damages caused by the issuing of inaccurate and/or incomplete information, regardless of the nature and extent of such damages or of that information, and regardless of the source of that information.
Team Nijhof will not be liable for any damages that arise prior to, during, and/or after the end of the Auction that are caused by or to persons, and/or by or to property, and/or by or to horses.
Team Nijhof will not be liable for any damages, either direct or indirect, and regardless of the nature and extent of such, as a result of any shortcoming in the fulfillment of an obligation by a third party or third parties.
Team Nijhof shall not be liable for the non-fulfilment of any obligation as a result of strikes, shortages, riots, civil unrest, fire, floods, storms, explosions, natural disasters, war, epidemics and/or pandemics, government interventions, working conditions, earthquakes, material defects, or any other circumstance over which Team Nijhof cannot reasonably exercise any control.
The Bidder/Buyer will be liable for all damages caused by it, and shall indemnify Team Nijhof against any claims of third parties, such to include, but not limited to, Sellers and/or other Bidders/Buyers, in connection with these damages, regardless of the nature or extent of such.
Exclusions of the liability of Team Nijhof shall not apply in the event of any willful misconduct or gross negligence on the part of Team Nijhof which is imputable to Team Nijhof.
Any liability of Team Nijhof will at all times be limited to a maximum amount of € 10,000. A claim for damages expires in any case twelve (12) months after the buyer became familiar with the damage that has directly or indirectly resulted from an event or circumstance for which Team Nijhof is or could be liable.

7 – Turnover Tax (VAT)

Team Nijhof is registered for turnover tax (VAT). Changes to the applicable VAT rate can lead to a corresponding adjustment of the applicable VAT percentages.
If in relation to the delivery of an auctioned horse to another Member State of the European Union invoicing with zero rate VAT takes place at the request of the Bidder/Buyer, the Bidder/Buyer obligates itself to fulfil all the necessary conditions in order to effect a legally valid intra-Community transaction.
If the application of zero rate VAT (subsequently) proves not to be possible due to any circumstances whatsoever, as of that moment the Bidder/Buyer shall then owe an amount equal to the amount that would have been owed in the event of a domestic sale of the relevant horse. At the request of Team Nijhof, however, the Bidder/Buyer will be obligated to pay the aforementioned amount immediately to Team Nijhof. In that case, the repayment of such shall only take place if and when the Bidder/Buyer has fulfilled the conditions to the satisfaction of Team Nijhof. The Bidder/Buyer will in any case be liable for and shall indemnify Team Nijhof against all damages that arise out of the non-fulfilment of the conditions. Furthermore, the Bidder/Buyer will be liable for all judicial and extrajudicial costs incurred by Team Nijhof, with a minimum amount of € 1,000.
Prior to the Auction, an announcement will be made about the applicable VAT regime under which each horse is being auctioned.

8 – Disputes and applicable law

The legal relationships between Team Nijhof and the Seller, between Team Nijhof and the Buyer, and between the Seller and the Buyer shall be exclusively governed by Dutch law, with the total exclusion of the Vienna Sales Convention (CISG). Disputes will be settled in accordance with the Arbitration Regulations of the NAI (Netherlands Arbitration Institute) by a single arbitrator to be appointed in accordance with the list procedure. The arbitration proceedings will be held in Dutch. If the Buyer is a consumer, then at his/her written request the District Court of Gelderland, Zutphen location, shall have competence to hear the dispute. If the Seller and/or Team Nijhof wants to institute dispute settlement proceedings and the Buyer is a consumer, the Seller/Team Nijhof shall give the Buyer a period of one month to give a written notice of the Buyer’s choice to have the dispute settled by NAI arbitration or by the District Court of Central Netherlands, Utrecht location. In the event of an urgent interest (preliminary relief proceedings), the Seller/Team Nijhof can reduce this period to five working days.
These terms and conditions of auction are drafted in the Dutch and in the English language. In the case of a dispute with regard to the English version of these terms and conditions of auction or their translation, the Dutch version shall prevail.

Algemene voorwaarden

1 – Algemeen

Deze voorwaarden zijn van toepassing op de online paardenveiling die georganiseerd wordt door de besloten vennootschap Sportstal Team Nijhof B.V.
Deze Online Veilingvoorwaarden maken onlosmakelijk deel uit van elke overeenkomst tussen de besloten vennootschap Sportstal Team Nijhof B.V., gevestigd te Geesteren gld, gemeente Berkelland, en deelnemers aan de door Team Nijhof georganiseerde online veiling van paarden via internet op https://team-nijhof. auction (“Veilingsite”). Alle deelnemers, waaronder kopers en verkopers, worden geacht de toepasselijkheid van deze Veilingvoorwaarden te hebben aanvaard. Deze algemene voorwaarden prevaleren boven enig andere voorwaarde ingeval van strijdigheid. Team Nijhof aanvaardt geen enkele andere algemene voorwaarden van deelnemers.
Sportstal Team Nijhof B.V. organiseert en faciliteert de Veiling en veilt de paarden in opdracht van een verkoper (“Verkoper”). Sportstal Team Nijhof kan op geen enkele wijze als verkoper worden aangemerkt tenzij uitdrukkelijk is vermeld dat zij in haar hoedanigheid van verkoper een paard op de online veiling aanbiedt.
Koper is degene die het bod tijdens de Veiling uitbrengt dat door Verkoper als hoogste bod wordt aanvaard. Tussen Koper en Verkoper komt een Koopovereenkomst (“Koopovereenkomst”) tot stand op het moment dat Verkoper een bod van Bieder/Koper aanvaardt (“Afslagbedrag”). Alle bedingen in deze Veilingvoorwaarden zijn mede gemaakt ten behoeve van al degenen voor, ten behoeve van en/of namens Team Nijhof werkzaam zijn of waren. Zij kunnen op bepalingen van deze Veilingvoorwaarden rechtstreeks een beroep doen, als waren zij zelf Team Nijhof.
Alle bedragen genoemd in deze Veilingvoorwaarden zijn exclusief BTW, tenzij anders vermeld.

2 - De veiling

De Veiling vindt plaats onder leiding van Team Nijhof. Team Nijhof bepaalt de orde en volgorde van de Veiling. Team Nijhof heeft het recht een ieder zonder opgaaf van redenen toegang tot en/of deelname aan de Veiling te weigeren, dan wel (nadere) voorwaarden aan deelname aan de Veiling te stellen.
Om als Bieder deel te kunnen nemen aan de Veiling is registratie op de door Team Nijhof voorgeschreven wijze vereist en dient, zonder voorbehoud, te worden ingestemd met de voorwaarden en procedures die door Team Nijhof op de Veiling van toepassing zijn en/of worden verklaard. Team Nijhof behoudt zich het recht voor om registratie voor de Veiling en (verdere) deelname van een Bieder aan de Veiling om haar moverende redenen op elk moment te weigeren en/of eenzijdig te beëindigen. Bieder dient zich voor deelname aan de Veiling digitaal te registreren op de Veilingsite. Bieder krijgt een strikt persoonlijke gebruikersnaam en wachtwoord waarmee toegang tot het biedsysteem mogelijk is. Bieder is verantwoordelijk voor alle handelingen die op de Veiling plaatsvinden en die voortvloeien uit gebruik van Bieders gebruikersnaam en wachtwoord. Biedingen geschieden digitaal/elektronisch. Per paard is het hoogste bod aangegeven op de Veilingsite.
De Veiling sluit op vooraf aangegeven datum en tijdstip. De duur van de Veiling staat aangegeven op de Veilingsite. Indien de laatste vijf minuten voor de aangegeven sluitingstijd een bod wordt uitgebracht wordt de openingstijd (steeds) met vijf minuten verlengd. Definitieve sluiting vindt vervolgens plaats vijf minuten na het laatste bod.
Een Bieder aanvaardt de bijzondere omstandigheden die zich bij een online-veiling kunnen voordoen waaronder technische onvolkomenheden waardoor niet tijdig een bod kan worden uitgebracht.
Een bieder met het één na hoogste bod is verplicht om zijn/haar bod gedurende 14 dagen na sluiting van de online veiling gestand te doen voor het geval het hoogste bod ongeldig wordt verklaard of niet gestand wordt gedaan.
De ter Veiling aangeboden paarden worden voetstoots geveild/verkocht zonder actie of refactie, in de staat waarin zij zich bij gunning bevinden, zonder aansprakelijkheid van Team Nijhof verband houdende met de waarde, de staat en/of de hoedanigheid van geveilde paarden. Het risico van verlies van en/of van schade aan en/of van schade veroorzaakt door het geveilde/gekochte paard berust bij Bieder/Koper vanaf het moment van totstandkoming Koopovereenkomst.
Bieder/Koper biedt voor eigen rekening en risico en is aan zijn bod gehouden totdat een hoger bod is geaccepteerd.
Team Nijhof kan niet garanderen dat Verkoper de eigendom van een geveild paard vrij en onbezwaard aan Bieder/Koper over kan dragen en Team Nijhof is niet aansprakelijk voor eventuele daarmee verband houdende schade.
Zolang Team Nijhof geen algehele betaling van Bieder/Koper heeft ontvangen, ook krachtens eventuele andere Koopovereenkomsten, blijft Verkoper eigenaar van het paard en kan nakoming vorderen. Verkoper is niet verplicht om het paard te leveren voordat de koopsom en veilingskosten door Koper zijn betaald. Eerst na schriftelijke toestemming van Team Nijhof is Verkoper bevoegd het verkochte paard aan Koper te leveren.
Deelname aan de Veiling impliceert dat de koper uitdrukkelijk en zonder enig voorbehoud akkoord gaat met deze veilingvoorwaarden en met de verschuldigdheid van de veilingkosten van 10% en 21% BTW (indien van toepassing) over de afslagprijs.

3 - Informatie

Team Nijhof stelt de Veilingsite zo zorgvuldig mogelijk samen. De informatie op de Veilingsite is erop gericht een indruk te geven van de kwaliteit van de ter Veiling aangeboden paarden, zonder dat Team Nijhof hiermee volledigheid betracht en zonder dat daaraan rechten kunnen worden ontleend.
De ter Veiling aangeboden paarden zijn veterinair klinisch en röntgenologisch onderzocht. De röntgenbeelden zijn binnen drie maanden voorafgaand de Veiling gemaakt. De in dat kader gemaakt röntgenbeelden en klinisch rapport zijn voorafgaand de Veiling op de Website door een iedere aan te vragen.
De inhoud van de genoemde veterinaire rapportages is bindend voor Team Nijhof, voor Verkoper en voor Bieder/Koper.
Voorafgaand aan de Veiling zijn de ter Veiling aangeboden paarden te bezichtigen op een nader door Team Nijhof aan te geven tijdstip en locatie.

4 - Afslagbedrag, opgeld, koopsom, betalingsverplichting koper

Koper dient binnen zeven (7) kalenderdagen na het moment van totstandkoming Koopovereenkomst de Koopsom in Euro’s aan Team Nijhof te betalen door overmaking op het bankrekeningnummer ten name van Team Nijhof, zonder enige korting of verrekening. De Koopsom wordt als volgt berekend: het Afslagbedrag wordt vermeerderd met een bedrag gelijk aan 10% van het Afslagbedrag (“Opgeld”), een en ander te vermeerderen met het van toepassing zijnde BTW tarief. Het BTW tarief is afhankelijk van de hoedanigheid/nationaliteit van Verkoper, Koper en van toepasselijke regelgeving.
Bij gebreke aan tijdige betaling van de Koopsom is Bieder/Koper in verzuim en heeft Team Nijhof het recht het paard onmiddellijk onderhands te verkopen, waarbij het bod van de oorspronkelijke Bieder/Koper niet meer geldt. Bieder/Koper heeft nimmer recht op een meeropbrengst bij onderhandse verkoop en blijft gehouden de minderopbrengst aan Team Nijhof te vergoeden. Team Nijhof heeft dan voorts de bevoegdheid zonder ingebrekestelling namens Verkoper en zonder Verkopers toestemming de Koopovereenkomst als ontbonden te beschouwen zonder dat Bieder/Koper een recht op (schade)vergoeding(en) toekomt. In geval van verzuim van Koper heeft Team Nijhof een retentierecht op het paard, is Bieder/Koper aan Team Nijhof administratiekosten verschuldigd ter hoogte van 6% van de Afslagbedrag en is Bieder/Koper alle (buiten) gerechtelijke kosten gemoeid met incasso van VOS’ vordering op Bieder/Koper, met een minimum van € 1.000,--, aan VOS verschuldigd. Koper komt geen recht op verrekening toe.

5 - (Af)levering, eigendomsoverdracht en ophalen

Na de Veiling en ontvangst van de Koopsom (al dan niet vermeerderd met BTW) door Team Nijhof zullen de Koper, de Verkoper en Team Nijhof het tijdstip en de wijze van de feitelijke levering van het paard overeenkomen. Tenzij anders overeengekomen tussen Team Nijhof, de verkoper en de koper wordt het paard op de locatie van de Verkoper opgehaald door de Koper. De feitelijke levering van het paard dient in ieder geval binnen veertien (14) dagen nadat de Koper al hetgeen hij/zij verschuldigd is aan Team Nijhof op grond van de in het kader van de Veiling gesloten overeenkomst(en) heeft voldaan, plaats te vinden. Na deze veertien (14) dagen is de verkoper van het Paard gerechtigd stallings- en verzorgingskosten bij de Koper in rekening te brengen.

6 – Uitsluiting en beperking aansprakelijkheid Team Nijhof

Team Nijhof is niet aansprakelijk voor schade veroorzaakt door verstrekking van onjuiste en/of onvolledige informatie, ongeacht aard en omvang van die schade en van die informatie en ongeacht de herkomst van die informatie.
Team Nijhof is niet aansprakelijk voor schade ontstaan voorafgaand aan, tijdens en/of na afloop van de Veiling veroorzaakt door of aan personen en/of door of aan zaken en/of door of aan paarden.
Team Nijhof is niet aansprakelijk voor schade, direct noch indirect en ongeacht aard en omvang, als gevolg van een tekortkoming in de nakoming van een verbintenis door een derde(n). Evenmin is Team Nijhof aansprakelijk voor enige gebrek aan een paard dat in de veiling wordt aangeboden.
Team Nijhof is niet aansprakelijk voor de tekortkoming in de nakoming van enige verplichting die het gevolg is van staking, tekorten, rellen, onlusten, brand, overstroming, storm, explosies, natuurrampen, oorlog, epidemieën en/of pandemieën, overheidsingrijpen, arbeidsomstandigheden, aardbevingen, materiaalgebrek of iedere andere omstandigheid waarop Team Nijhof in redelijkheid geen invloed kon uitoefenen.
Bieder/Koper is aansprakelijk voor alle schade door hemzelf veroorzaakt en vrijwaart Team Nijhof tegen iedere aanspraak van (een) derde(n), waaronder mede begrepen, maar niet beperkt tot, Verkopers en/of andere Bieders/Kopers, verband houdende met die schade, ongeacht aard en omvang.
Uitsluitingen van aansprakelijkheid van Team Nijhof gelden niet in geval van aan Team Nijhof toe te rekenen opzet of grove schuld van Team Nijhof.
Iedere aansprakelijkheid van Team Nijhof is te allen tijde beperkt tot een bedrag van maximaal € 10.000,--. Een aanspraak op schadevergoeding vervalt in ieder geval twaalf (12 maanden) nadat de koper bekend wordt met de schade, welke direct of indirect voortvloeit uit een gebeurtenis of omstandigheid waarvoor Team Nijhof aansprakelijk is of zou kunnen zijn.

7 - Omzetbelasting

Team Nijhof is ondernemer voor de omzetbelasting. Wijzigingen ten aanzien van het geldende BTW-tarief kunnen aanleiding zijn voor een overeenkomstige aanpassing van de toe te passen BTW percentages.
Indien ter zake van de overgang van geveilde paarden naar een andere lidstaat van de Europese Unie op verzoek van de Bieder/Koper wordt gefactureerd met het BTW-nultarief, verplicht de Bieder/Koper zich alle daartoe noodzakelijke voorwaarden te vervullen teneinde een rechtsgeldige intracommunautaire transactie te verwezenlijken.
Indien toepassing van het BTW-nultarief door welke omstandigheid dan ook (achteraf) niet mogelijk blijkt, is de Bieder/Koper op dat moment alsnog een bedrag verschuldigd ter grootte van het bedrag dat verschuldigd zou zijn indien sprake is van een binnenlandse levering van het desbetreffende paard. Op verzoek van Team Nijhof is de Bieder/Koper echter verplicht vorenbedoeld bedrag onmiddellijk aan Team Nijhof te voldoen. Alsdan zal terugbetaling daarvan eerst en slechts plaatsvinden indien de bieder/koper naar genoegen van Team Nijhof aan de voorwaarden heeft voldaan. De Bieder/Koper is aansprakelijk en vrijwaart Team Nijhof in ieder geval voor alle schade die voortvloeit uit het niet voldoen aan de voorwaarden. Daarnaast is de Bieder/Koper aansprakelijk voor alle (buiten)gerechtelijke kosten die Team Nijhof maakt, met een minimumbedrag van € 1.000,--.
Per paard wordt voorafgaand aan de Veiling kenbaar gemaakt onder welk BTW regiem het betreffende paard wordt geveild.

8 - Geschillen en toepasselijk recht

De rechtsverhoudingen tussen Team Nijhof en Verkoper, tussen Team Nijhof en Koper en tussen Verkoper en Koper worden uitsluitend beheerst door Nederlands recht, met algehele uitsluiting van het Weens Koopverdrag (CISG). Geschillen, zullen worden beslecht overeenkomstig het Arbitragereglement van het NAI (Nederlands Arbitrage Instituut) door één arbiter te benoemen volgens de lijstprocedure. De arbitrageprocedure wordt in de Nederlandse taal gevoerd. Indien Koper een consument is, is op diens schriftelijke verzoek de Rechtbank Gelderland, locatie Zutphen, bevoegd. Indien Verkoper en/of Team Nijhof een procedure aanhangig wil maken en Koper is consument, zal Verkoper/Team Nijhof gedurende een maand Koper in de gelegenheid stellen schriftelijk Kopers keuze voor NAI-arbitrage of de Rechtbank Gelderland, locatie Zutphen, kenbaar te maken.
Deze veilingvoorwaarden zijn in de Nederlandse en Engelse taal opgesteld. In geval van een geschil met betrekking tot de Engels versie van deze veilingvoorwaarden of de vertaling daarvan, prevaleert de Nederlandse versie.
